Cercy jury recessed for night, start deliberating again Wednesday morning

The jury of three men and nine women was allowed to return home for the evening, in the sexual assault trial of Tony Scott Cercy. They will resume deliberations tomorrow, November 21st.

Cercy faces one count of 3rd Degree sexual assault, after an alleged incident that occurred during the summer of 2017. This is the second trial against Cercy on such charges.

The alleged victim in the case claims that after a day of drinking with friends at the lake in June 2017, she attended a party at the Cercy home near Alcova Reservoir. The woman claims to have passed out at the party and awoke in the early morning hours the following day to find Cercy performing oral sex on her.

Cercy had been previously acquitted earlier in 2018, on one count each of 1st and 2nd Degree Sexual Assault. A charge of 3rd Degree Sexual Assault led to a hung jury. He is being re-tried on the 3rd Degree charge.

The jury heard closing arguments in the case Tuesday morning, and began deliberations at just after the noon hour. After approximately nine hours, Jen Tuma, the Clerk of Natrona County District Court, informed media and others in the courtroom that the jury had retired for the evening and would resume again tomorrow.

The trial began on November 9th, with the jury’s selection.

The case was moved to Hot Springs County county in June of 2018, after members of the Cercy defense team asked Natrona County District Court for a change-of-venue, citing media coverage of the events surrounding the early 2018 trial.
